The Problem: A $440,000 Wake-Up Call

In October 2025, one of the world's most recognisable consulting brands became a cautionary tale. Deloitte Australia was compelled to refund AU$97,000 of its AU$440,000 contract with the federal Department of Employment and Workplace Relations after a University of Sydney researcher discovered that a 237-page independent assurance review contained fabricated citations, invented expert references, and a quote falsely attributed to a federal court judge. The cause: undisclosed use of Microsoft Azure OpenAI GPT-4o, deployed for core analytical tasks without any disclosure to the client or the public.

The incident was not merely an embarrassment. It was the first major public case of a government receiving a financial repayment over undisclosed AI use in contracted work, and it instantly transformed a theoretical governance question into an urgent commercial and legal risk for every professional services firm that deploys AI in client-facing deliverables.

The fallout was swift and pointed. Senator Deborah O'Neill told the Australian Financial Review that anyone looking to contract consulting firms should be asking exactly who is doing the work they are paying for, and having that expertise and AI use verified. Senator Barbara Pocock called for a full refund. The firm, which had simultaneously announced a multi-billion dollar AI investment strategy, found itself defending the very AI practices it was selling to clients.

The Regulatory Landscape Is Shifting Faster Than Most Firms Anticipated

For legal departments at major consulting firms and their government clients, the Deloitte episode arrived alongside a parallel signal from the judiciary: disclosure expectations are hardening into enforceable obligations.

In August 2025, King's Counsel Rishi Nathwani appeared before the Supreme Court of Victoria to apologise after filing submissions in a murder case that contained AI-generated fabrications, including fake legislative quotes and nonexistent case citations. The errors were discovered not by the defence team, but by the judge's associates, who could not locate the cited cases and requested copies. The lawyers admitted the citations did not exist. Justice James Elliott stated that the court's ability to rely on the accuracy of counsel's submissions is fundamental to the administration of justice. The AI-generated errors caused a 24-hour delay in a case the court had expected to conclude that day.

This was not an isolated incident. In 2023, a US federal judge fined two lawyers and their firm after ChatGPT produced fictitious case citations in an aviation injury claim. Fictitious AI-generated rulings also appeared in court filings by lawyers for Michael Cohen. The pattern across every jurisdiction is consistent: AI produces confident, fluent output, and professionals assume it is accurate without checking.

On 16 April 2026, Chief Justice Debra Mortimer of the Federal Court of Australia issued a formal Practice Note (GPN-AI) governing the use of generative AI in all proceedings before the Court. The Practice Note establishes that presenting false or inaccurate information generated by AI is unacceptable and inconsistent with the responsibility on all persons to not mislead the court. Where the Court requires it, any person involved in proceedings must disclose what generative AI was used, how it was used, and for what purpose.

The Federal Court ruling does not stand alone. Across Australia, courts and tribunals at every level have implemented or are developing AI disclosure frameworks, including the Supreme Courts of New South Wales, Victoria, Queensland and Western Australia, and multiple state tribunals. In the United States, a February 2026 federal court ruling found that AI-processed documents may lose legal professional privilege entirely.

For general counsel and legal departments inside major consulting firms, the message is clear: the question is no longer whether AI disclosure will be required. It is whether your firm will have a defensible, auditable, and consistent answer ready when it arrives, from a client, a regulator, a judge, or a parliamentary committee.

The Disclosure Gap: Shadow AI, Auditability, and Reputational Risk

Across the professional services sector, AI adoption has outpaced governance. Tools are deployed at team level without enterprise-wide visibility. Deliverables leave the building without any record of how much AI contributed to their content, or under whose judgment that contribution was made. There is no standard language, no consistent methodology, and no recognised credential for communicating the degree of human oversight applied to AI-assisted work.

The problem is not that AI is being used. The problem is that there is no standard way to say how, and how much. In the absence of that standard, the default assumption from clients and regulators is concealment.
